The terms at a glance
A quick summary to help you find your way. It isn’t a substitute for the full terms below, which are what legally apply.
A licence to play
Use TuneForge on your own Android devices for your own music — at home, on stage, in the studio or while teaching.
Play fair
Please don’t copy, resell, reverse engineer or misuse TuneForge or this website.
Readings are a guide
TuneForge is built to be accurate, but check before making physical changes to your instrument.
Your legal rights come first
Nothing in these terms takes away the rights you have as a consumer where you live.
01About these terms
In short: these terms are a legal agreement between you and us. By using TuneForge, you accept them.
These Terms and Conditions (“terms”) govern your use of the TuneForge app for Android (the “app”) and this website (the “website”), which together we call “TuneForge”. They form a legal agreement between you and the developer and publisher of TuneForge named on its Google Play listing (“we”, “us” or “our”).
By downloading, installing, accessing or using TuneForge, you agree to these terms. If you don’t agree with them, please don’t use TuneForge.
Our Privacy Policy explains how we handle personal information. It isn’t part of these terms, but we recommend reading it alongside them.
You download TuneForge from Google Play, so the Google Play Terms of Service also apply to your download and to any purchase. Those terms govern your relationship with Google; these terms govern your relationship with us. We — not Google — are responsible for the app and its content.
02Who can use TuneForge
In short: anyone can use TuneForge. If you’re under 18, please make sure a parent or guardian is happy with these terms.
You may use TuneForge if you can form a binding contract with us. If you’re under 18, or under the age of majority where you live, you may use TuneForge only with the involvement and agreement of a parent or guardian, who accepts these terms on your behalf.
If you use TuneForge on behalf of an organisation — such as a school, music service or band — you confirm that you’re authorised to accept these terms on its behalf, and “you” includes that organisation.
03Your licence to use TuneForge
In short: we give you a personal right to install and use TuneForge on your devices, for your own music. We still own the app.
Subject to these terms, we grant you a personal, worldwide, revocable, non-exclusive, non-transferable and non-sublicensable licence to download, install and use the app on Android devices that you own or control, and to use the website.
You may use TuneForge for your own music, whether you’re practising at home or playing professionally — for example when performing, recording, teaching or setting up instruments. What you may not do is offer TuneForge itself to others as a product or service.
TuneForge is licensed to you, not sold. We and our licensors keep all rights that these terms don’t expressly give you.
04Price, purchases and refunds
In short: any price is shown on Google Play before you buy, and payments and refunds are handled by Google Play.
The price of TuneForge, if any, and of any optional in-app purchase we may offer in future, is shown on Google Play before you buy. All purchases are processed by Google Play and are subject to the Google Play Terms of Service and Google Play’s payment and refund policies. We never see or store your payment card details.
Refund requests are handled by Google Play in line with its refund policies. You may also be entitled to a repair, replacement or refund under consumer law if TuneForge is faulty or not as described — see section 12. Nothing in this section limits those rights.
05Using TuneForge responsibly
In short: use TuneForge lawfully, and don’t try to copy, break or misuse it.
When you use TuneForge, you agree not to:
- copy, modify, adapt, translate or create derivative works of the app, except as these terms or the law expressly allow;
- sell, rent, lend, sublicense, distribute or otherwise make the app available to anyone else;
- decompile, disassemble or reverse engineer the app, or try to access its source code, except to the extent the law allows despite this restriction — for example, where necessary for interoperability;
- remove, hide or change any copyright, trade mark or other notice;
- interfere with, disrupt or try to bypass any security or technical feature of the app or the website, or introduce anything harmful, such as malware;
- use automated tools to access, scrape or overload the website;
- use TuneForge in any unlawful or fraudulent way, or in a way that infringes anyone else’s rights; or
- use the TuneForge name, logo or artwork in a way that suggests we endorse you or that’s likely to cause confusion, without our written permission.
06Tuner readings, calculations and safety
In short: TuneForge is designed to be accurate, but it’s a guide. Check before adjusting your instrument, and take care with string tension and volume.
We work hard to make TuneForge accurate and reliable. Its readings and results also depend on things outside our control, so they’re provided as a guide:
- Pitch detection depends on your device’s microphone, background noise, the sound of your instrument and how it’s played.
- Fret positions are calculated from the scale length you enter, using standard fret-spacing formulas. Real instruments also depend on nut and saddle placement, compensation and build tolerances.
- String tension figures are estimates for plain steel strings, based on the values you enter. Manufacturers’ published figures and real-world conditions may differ.
- Chord shapes and transpositions are standard references. You may prefer other voicings, and some shapes won’t suit every instrument or tuning.
Before cutting, filing, fretting or otherwise altering your instrument, or tuning to a higher tension than usual, please check the manufacturer’s guidance or ask a qualified technician. Bringing strings up to pitch too quickly or too high can damage an instrument or make a string break, so tune gradually and keep your face and eyes clear of the strings.
When you use the metronome, the drone or reference notes, keep the volume at a comfortable level, especially with headphones. Prolonged listening at high volume can damage your hearing.
To the extent the law allows, we’re not responsible for damage to instruments or equipment that results from relying on a reading or calculation without taking these precautions. This doesn’t limit our responsibility for defective digital content described in section 12.
07Your tunings and settings
In short: the custom tunings and settings you create are yours, and they stay on your device.
Custom tunings, names and settings you create in TuneForge are stored on your device. They belong to you, we don’t claim any rights in them, and we can’t access them. Because they’re stored locally, uninstalling the app or clearing its storage will delete them, so keep a note of anything you’d like to hold on to.
08Intellectual property
In short: TuneForge’s software, design and brand belong to us or our licensors.
The app and the website, including their software, design, text, graphics, artwork and sounds, the TuneForge name and the TuneForge guitar-pick logo, are owned by us or our licensors and are protected by copyright, trade mark and other intellectual property laws. Apart from the licence in section 3, these terms don’t give you any rights in them.
TuneForge may include open-source software, which is licensed under its own terms. Where an open-source licence gives you rights that these terms would otherwise restrict, that licence takes precedence for that software. The website uses the Inter typeface, licensed under the SIL Open Font License, and icons from Lucide, licensed under the ISC License.
If you send us ideas, suggestions or feedback, you agree that we may use them to improve TuneForge without any obligation to you.
Android and Google Play are trademarks of Google LLC. Other names and marks mentioned on the website belong to their respective owners, and mentioning them doesn’t imply any endorsement.
09Updates, availability and compatibility
In short: we’ll keep improving TuneForge. Occasionally that means changing or removing things, and it may not work on every device.
We may release updates to fix problems, improve performance and security, respond to changes in Android or the law, or add, change or remove features. Some updates may be needed to keep using TuneForge. If an update would significantly reduce what you can do with TuneForge, we’ll tell you in advance wherever reasonably possible.
TuneForge needs a compatible Android device, and the tuner needs a working microphone. Minimum requirements are shown on Google Play. We can’t guarantee that TuneForge will work with every device, Android version or accessory, or that it will always be available, uninterrupted or free from errors.
We may suspend or stop offering TuneForge, or part of it. If we decide to stop supporting the app, we’ll try to give reasonable notice. Doing so doesn’t affect any legal rights you have in relation to a purchase you’ve already made.
10Using our website
In short: the website is here to tell you about TuneForge. We keep it accurate, but details can change.
The website provides general information about TuneForge. We aim to keep it accurate and up to date, but features, screenshots, availability and other details may change and may not always reflect the current version of the app. Screens are shown for illustration, and the colour preview is a demonstration that doesn’t change anything in the app.
You may view the website and print or save pages for your own personal, non-commercial reference. Except as the law allows, you may not copy, reproduce or republish its content — including its text, artwork and screenshots — for any other purpose without our permission.
11Third-party services and links
In short: Android, Google Play and other services are provided by others, under their own terms.
TuneForge relies on services provided by third parties, including Android, Google Play and our website host, and the website may link to other websites. We don’t control those services or websites and aren’t responsible for their content, availability or practices. Your use of them is governed by their own terms and privacy policies.
12Our responsibility to you
In short: if TuneForge is faulty or not as described, you have legal rights — and nothing in these terms takes them away.
We want TuneForge to work well for you. If something isn’t right, please contact us first — we’d much rather put it right.
Your rights as a consumer
If you’re a consumer, you have legal rights in relation to digital content that is faulty or not as described. In the UK, for example, the Consumer Rights Act 2015 says that digital content must be of satisfactory quality, fit for purpose and as described. If it isn’t, you may be entitled to a repair or a replacement, or to some or all of your money back. Nothing in these terms affects those rights. For advice about your rights, contact your local consumer advice organisation, such as Citizens Advice in the UK.
If defective digital content that we’ve supplied damages a device or other digital content belonging to you, and this is caused by our failure to use reasonable care and skill, we’ll either repair the damage or compensate you. We won’t be responsible for damage that you could have avoided by following our advice to install a free update, or damage caused by not following installation instructions or not having the minimum system requirements we’ve told you about.
Beyond your legal rights
Except for the commitments in these terms and the rights you have by law, TuneForge is provided “as is” and “as available”. To the fullest extent the law permits, we make no other promises about TuneForge — for example, that it will meet your particular requirements, be available without interruption, or be entirely free from errors.
13Limitation of liability
In short: we’re responsible for foreseeable loss we cause, but not for loss we couldn’t have foreseen or for business losses. And nothing limits liability that the law says can’t be limited.
What we never exclude. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can’t be excluded or limited by law.
If you’re a consumer. If we fail to comply with these terms, we’re responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill. Loss or damage is foreseeable if it’s obvious that it will happen or if, when you obtained TuneForge, both of us knew it might happen. We’re not responsible for loss or damage that isn’t foreseeable.
Business losses. TuneForge is supplied for personal use. If you use it for any commercial or business purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
Where the law allows a limit. Subject to the paragraphs above, and to the extent permitted by the law that applies to you, we aren’t liable for any indirect, incidental, special, consequential or punitive damages, and our total liability to you for all claims arising out of or relating to TuneForge is limited to whichever is greater: the amount you paid for TuneForge in the twelve months before the claim arose, or 50 US dollars (or the equivalent in your local currency).
14Ending these terms
In short: you can stop using TuneForge at any time. We may end your licence if you seriously break these terms.
You can stop using TuneForge whenever you like by uninstalling the app. These terms continue to apply for as long as you use TuneForge.
We may suspend or end your right to use TuneForge if you seriously or repeatedly break these terms. Where it’s reasonable to do so, we’ll tell you first and give you a chance to put things right.
If your licence ends, you must stop using TuneForge and delete the app. The sections that by their nature should continue — including those on intellectual property, our responsibility to you, limitation of liability and governing law — will continue to apply.
15Changes to these terms
In short: we may update these terms. If a change is significant, we’ll let you know before it takes effect.
We may update these terms to reflect changes to TuneForge, to the law or to how we operate. We’ll publish the updated terms on this page and change the “Last updated” date at the top.
If a change is significant, we’ll give you reasonable notice before it takes effect — for example in the app, on our Google Play listing or on this website. If you don’t agree with a change, you can stop using TuneForge before it takes effect. If you carry on using TuneForge after that, the updated terms will apply.
16Governing law and disputes
In short: these terms are governed by the law shown below, but as a consumer you always keep the protection of the law where you live.
These terms, and any dispute or claim arising out of or in connection with them, are governed by the law of the country in which the developer of TuneForge is established, and the courts there have non-exclusive jurisdiction.
If you’re a consumer, you also benefit from any mandatory provisions of the law of the country where you live, and you can bring proceedings in the courts of that country.
If you have a concern, please contact us first. Most problems can be solved quickly and informally, and we’ll do our best to help.
17General
In short: the legal details that make these terms work.
- Entire agreement. These terms are the whole agreement between you and us about TuneForge, and they replace any earlier agreement or understanding about it.
- Severability. If a court decides that any part of these terms is invalid or unenforceable, the rest will continue in full force.
- No waiver. If we don’t enforce a right straight away, we can still enforce it later.
- Transfer. We may transfer our rights and obligations under these terms to another organisation, and we’ll make sure the transfer doesn’t reduce your rights. You may transfer your rights or obligations only with our written consent.
- Third parties. Nobody other than you and us has any right to enforce these terms.
- Events outside our control. We’re not responsible for delays or failures caused by events outside our reasonable control.
- Language. These terms are written in English. If they’re ever translated, the English version applies to the extent the law permits.
